NO PURCHASE NECESSARY TO PARTICIPATE OR RECEIVE A REWARD. These Terms of Participation constitute a binding agreement as to your participation in The BIG Ho-Ho-Holiday Hunt. Do not participate in The BIG Ho-Ho-Holiday Hunt unless you have read, understand and agree to these Terms of Participation. These Terms of Participation supersede any prior understandings or agreements, whether oral or written.

PROMOTER/SPONSOR: Big Lots Stores, LLC, 4900 E. Dublin Granville Rd., Columbus, OH 43081 ("Promoter").

The Big Lots BIG Ho-Ho-Holiday Hunt ("Promotion") begins on the opening of store hours and ends at the close of store hours for each participating Big Lots store location ("Location") on December 7, 2024, December 14, 2024, and December 21, 2024 (the "Promotion Period"). The Promotion will solely take place during store hours at each of the participating Locations during the three days of the Promotion Period (each a "Promotion Date"). All Big Lots Stores other than closing stores are participating locations.

ELIGIBILITY: Promotion open only to legal residents of the contiguous United States and the District of Columbia who are 18 years of age or older at the time of participation (excluding residents of Puerto Rico, and all other U.S. territories and possessions). Void in Puerto Rico and all other U.S. territories and possessions and where prohibited by law. Employees of Promoter, the immediate family of employees (spouse, parents, siblings, children and each of their respective spouses, regardless of where they reside), and household members of each such employee, whether related or not, are not eligible to participate or receive a reward. The Promotion is governed by U.S. law and is subject to all applicable federal, state, and local laws and regulations.

PARTICIPATION RULES: Prior to the beginning of each Promotion Date, three (3) printed “holiday cards” will be hidden by store managers at each participating Location. Each of the holiday cards will feature a colored gift graphic that is associated with a gift card amount. Determination of the holiday cards and their associated gift card amounts are determined by Promoter, in its sole discretion. Promoter will post a clue at the beginning of each Promotion Date on a sign located at the front of store inside each Location and on @biglots Instagram & Facebook stories with a hint as to where the holiday cards will be hidden. The first eligible individual to identify and arrive at the location of a hidden holiday cards will be deemed a potential reward recipient of the corresponding reward and will be instructed to bring the holiday cards (listed on card) to a store associate to obtain their reward. Decisions of Promoter are final and binding in all matters relating to the Promotion, including the awarding of rewards, and shall not be subject to review or appeal by any participant or by any third party. Inappropriate or aggressive behavior amongst participants at any hidden holiday card location will not be tolerated and may result in such individuals being disqualified from participation in the Promotion, in Promoter's sole discretion. If there is a tie, or multiple individuals arrive at a hidden holiday cards location at the same time, Promoter reserves the right to conduct a coin toss or random drawing amongst the tied individuals to break the tie and provide one individual with the corresponding reward. If any hidden holiday cards are not identified and located by the end of any Promotion Date, Promoter reserves the right not to award any rewards for those holiday cards that were not identified and located by the end of the Promotion Date. Any/all transportation and costs associated with traveling to/from a participating Location will not be provided and will be each participant's sole responsibility.

REWARDS AVAILABLE: On each Promotion Date, three (3) Big Lots gift cards, worth $20, $50, and $100, will be available as a reward at each Location. Limit one (1) reward per person throughout the Promotion Period, regardless of participating Location(s) visited. No substitution, transfer, or cash equivalent of reward is permitted, except by Promoter, which reserves the right to substitute a reward with one of comparable or greater value, at its sole discretion.

GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for errors of any kind whether human, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors which may occur in connection with the administration of the Promotion, the posting or re-posting of any clues, the availability or dispersion of hidden holiday card or in any Promotion-related materials. Holiday cards are void if not obtained through authorized, legitimate channels, or if any holiday card or Promotion material is defective, altered, duplicated, photocopied, forged, counterfeited, mutilated or tampered with in any way, or if any holiday card or Promotion materials contain or are the result of printing, seeding, human, electronic, computer, typographical, mechanical or other errors, or do not contain proper security devices. Should any portion of the Promotion be, in Promoter's sole opinion, compromised by non-authorized human intervention or other causes, which, in the sole opinion of the Promoter, corrupt or impair the administration, security, or fairness of the Promotion or submission of information, Promoter reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Promotion.

By participating, you agree (i) to be bound by these Terms of Participation and the decisions of Promoter which are final and binding in all matters relating to the Promotion and Terms of Participation, and (ii) to release, discharge, indemnify and hold harmless Promoter, and its parents, affiliates, subsidiaries, licensees, retailers and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, “Released Parties”) against any liability, for any injuries, losses or damages of any kind, including death, to persons or property resulting in whole or in part, directly or indirectly, from participation in this Promotion (including any travel or activity related thereto) or the acceptance, possession, use or misuse of any reward.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Promotion, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any rewards provided, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Participant hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms of Participation, or the rights and obligations of participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of Ohio, USA, without regard to any conflict of law doctrines.
